1. Acceptance of Terms

By accessing or using Artixie ("the Game", "the Website", "our Services"), you confirm that you have read, understood, and agree to comply with these Terms of Service ("Terms"), all applicable laws, and any related regulations.

If you do not agree with any part of these Terms, you must not use or access our Services.

We may modify these Terms or our Privacy Policy at any time. Continued use of the Game following the publication of updates constitutes your acceptance of the revised Terms.

All original materials, assets, and content available through our Services are protected by applicable copyright, trademark, and other intellectual property laws. This service also makes use of open-source software components licensed under the following terms: "BSD 3-Clause License", "MIT License", "Apache License 2.0", "Open Font License". Ownership and copyright of these third-party components remain with their respective authors. For complete details, please refer to our Third-Party Licenses page.

You must be at least 13 years old to use the Game. If you are under 13, you may not use the Services or create an account. Users between 13 and 17 years of age should use the Game with the knowledge and supervision of a parent or legal guardian. If we learn that a user is under 13, we may remove the user's account and associated data and restrict access to the Services. We encourage parents and guardians to monitor their children's online interactions and guide them on not sharing personal data through the platform.

2. Accounts and Registration

2.1 Guest Access

You may play without registering by choosing a guest nickname. Guest nicknames are prefixed with ~ automatically to distinguish them from registered accounts. Guest sessions are temporary: scores, drawings, and any in-game activity are not persisted to a profile after the session ends.

2.2 Registered Accounts

Registration is performed exclusively through Google OAuth 2.0. By registering, you authorize us to receive your Google account ID, email address, display name, and profile picture URL from Google. We do not store passwords.

During setup you must choose a nickname. Nicknames must be between 3 and 18 characters and may contain only letters, numbers, and underscores. Your nickname is permanent once set and cannot be changed after initial setup. Choose it carefully.

You are responsible for maintaining the security of your Google account, which is the sole credential used to access Artixie. We are not liable for losses resulting from unauthorized access to your Google account.

2.3 Account Deletion

You may request deletion of your account at any time from your profile settings. Deletion requires confirmation via a link sent to your registered email address. The confirmation link expires after 1 hour. Upon deletion, your profile, drawings, wall posts, comments, likes, friendships, and all associated data are permanently removed. This action is irreversible.

3. Limited License of Use

We grant you a non-exclusive, revocable, and non-transferable license to access and play the Game for personal and non-commercial purposes only.

This license does not transfer ownership and is subject to the following restrictions. You are not allowed to:

If you breach any of these conditions, this license terminates immediately. You must then destroy or delete any copies of materials obtained from our Services. We reserve the right to pursue legal action for violations of this license.

4. Intellectual Property Rights

All original elements within Artixie, including but not limited to designs, graphics, artwork, logos, interface layouts, code, icons, sounds, animations, and textual content, are owned or lawfully licensed by us.

You are granted a limited right to use these materials solely for accessing and playing the Game as intended. Any unauthorized reproduction, modification, distribution, or derivative use is strictly prohibited.

When you create in-game drawings, art drawings, wall posts, comments, featured phrases, or other contributions ("User Generated Content" or "UGC"), you grant us a perpetual, royalty-free, and worldwide license to use, reproduce, display, distribute, and adapt such content in any media related to the Game, including on the homepage gallery, the exhibition page, and any official social media channels.

You retain ownership of your UGC but acknowledge that content marked as public or finished may be visible to all users of the Service. If other players' participation is included in your UGC, you must ensure they consent to its public use.

UGC containing the Artixie brand or logo cannot be commercialized or used for promotional purposes without our written authorization.

Except as otherwise stated, all rights, titles, and interests in and to the website and its original content are owned by the developers.

5. Gameplay Rules and Features

5.1 Lobbies and Rooms

The Game is organized into rooms by language and category (general, food, animals, objects, verbs). Each room enforces a maximum number of simultaneous connections to ensure fair access. Attempting to circumvent these limits through proxies, VPNs, or automated tools is a violation of these Terms.

Players who remain inactive for an extended period may be automatically removed from a lobby by the AFK system. You may confirm your presence when prompted to avoid being disconnected.

5.2 Scoring and Ranking

Points and wins are only counted in games with at least 3 connected players. Rankings are calculated daily, weekly, monthly, and yearly and are displayed publicly on the Game's ranking pages. We reserve the right to adjust, reset, or remove rankings if abuse or manipulation is detected.

Player levels and veteran badges are derived from accumulated scores and are subject to change as the player base grows. Level thresholds are recalculated periodically based on the total number of registered players.

5.3 Drawings

Registered players who complete a drawing turn may save that drawing to their profile gallery. Saved lobby drawings and art drawings are stored on our servers and may be displayed publicly on the homepage, the exhibition page, and the drawing owner's profile.

Art drawings created in the free drawing canvas (/draw) support multiple layers and may be marked as incomplete or finished. Only finished art drawings with a valid thumbnail are eligible for public display on the exhibition and homepage galleries.

Drawings may be reported by other users for violating community standards. Reported drawings are reviewed by administrators. Drawings found to be in violation may be removed without prior notice.

5.4 Social Features

Registered users may send and receive friend requests. The maximum number of friends per account is 500. Friend relationships enable wall posts between users and affect visibility of certain profile content.

Wall posts are messages left on a user's profile by themselves or their friends, with a maximum length of 500 characters. Profile owners may configure who can see their wall posts (public, friends only, or private) and may delete any post on their own wall. Authors may delete their own posts from any wall.

Registered users may leave comments (up to 160 characters) on art drawings. Comments are subject to a rate limit of 3 per minute. Drawing owners may delete any comment on their drawings. Comment authors may delete their own comments.

In-game reactions ("throw paint" and "throw heart") may be sent between players during a game session. When both players are registered, these reactions are recorded and contribute to a daily reputation display visible on profiles.

Daily and weekly ranking winners may publish a featured phrase (up to 160 characters) on the exhibition page. This phrase is public and visible to all users. Winners may remove their phrase within the allowed period.

6. User Conduct and Behavior Rules

By using our Services, you agree to respect all players and to avoid actions that disrupt gameplay or violate community standards.

The following behaviors are strictly prohibited:

  1. Using offensive, discriminatory, or harmful language, drawings, or content targeting any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
  2. Sharing or posting illegal material or violating third-party intellectual property rights.
  3. Advertising or promoting products, services, or external websites within the Game, in profiles, or anywhere else on the artixie website.
  4. Uploading or transmitting malware, viruses, or scripts that disrupt operations or harm other users.
  5. Impersonating another person, player, or entity, including Artixie staff.
  6. Using automated tools (bots, crawlers, scripts, or macros) to manipulate gameplay, scores, rankings, or server resources.
  7. Attempting unauthorized access to the Game's infrastructure, databases, or other users' accounts.
  8. Using inappropriate, offensive, or misleading nicknames.
  9. Publishing obscene, pornographic, or hateful material in any form, including drawings, comments, wall posts, or featured phrases.
  10. Encouraging or facilitating illegal activities of any kind.
  11. Abusing the drawing report or cancellation voting system to harass other players or disrupt legitimate gameplay.
  12. Circumventing or disabling Game security mechanisms, including connection limits or rate limiting.
  13. Attempting to reveal or guess the current word through the chat field in a way that violates the spirit of the game.

Violations may result in content removal, temporary or permanent account suspension, and, when necessary, reporting to the appropriate legal authorities.

7. Content Moderation and Reporting

We provide tools for players to report drawings they believe violate these Terms. In-game, players may also vote to cancel an ongoing drawing turn if they believe it contains inappropriate content. These tools exist to support a healthy community and must not be abused.

Reported content is reviewed by administrators. We reserve the right to remove any content, suspend any account, or take any other action we deem appropriate at our sole discretion, without prior notice and without obligation to provide a justification.

If you believe a player has violated these Terms, contact us at ArtixieGame@gmail.com with detailed information about the incident. We will review and take reasonable action in accordance with applicable regulations. We are not liable for losses or damages caused by other users' actions. Any claims must be directed to the responsible party.

We may cooperate with law enforcement authorities and disclose relevant information as required by law.

8. Commercial and Streaming Permissions

You may record, stream, or post videos of your gameplay on streaming platforms (such as Twitch, YouTube, or similar) under the following conditions:

Any violation of these conditions will result in automatic termination of this permission and may lead to additional legal consequences.

9. Feedback and Suggestions

If you provide ideas, suggestions, or feedback regarding improvements to the Game through any channel, including our suggestions page, you agree that we may freely use, adapt, and implement them without any obligation of compensation, credit, or acknowledgment.

10. Third-Party Advertisements

The Game may display advertisements provided by third parties. Clicking these ads may redirect you to external sites or services beyond our control.

We are not responsible for the accuracy, safety, or content of these external websites. If you encounter inappropriate or misleading ads, report them via ArtixieGame@gmail.com.

All liability related to third-party advertisements lies solely with the company responsible for the ad.

11. Limitation of Liability

Under no circumstances shall Artixie, its developers, suppliers, or affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the Game.

We are not responsible for user-generated content (drawings, messages, nicknames, wall posts, comments, featured phrases, etc.) nor for links or materials shared by players. The existence of such content does not imply our endorsement. Users are solely responsible for the content they create, submit, or display on the website.

We are not liable for technical interruptions, maintenance periods, data loss, or server unavailability that may temporarily or permanently affect access to the Game or to stored content such as drawings and profiles.

Scores, rankings, achievements, and badges are provided as entertainment features with no monetary or material value. We make no guarantee of their continuity and reserve the right to adjust, reset, or remove them at any time.

12. Applicable Law and Jurisdiction

These Terms shall be governed by and construed under the laws of Brazil, and any disputes shall be exclusively resolved in the courts located in Brazil.

13. Termination

We reserve the right to suspend or terminate access to the Game, remove content, or close accounts at any time, with or without notice, for violations of these Terms, abusive behavior, or for operational, maintenance, or security reasons.

Upon termination for cause, the limited license granted under Section 3 is immediately revoked and you must cease all use of the Service.

14. Modifications

We may update, modify, or revise these Terms of Service at any time without prior notice. Any changes will take effect immediately upon being posted on this page, with the "Last Updated" date adjusted accordingly. By continuing to access or use the website after such changes become effective, you agree to be bound by the updated version of these Terms.

15. Final Provisions

Failure or delay in enforcing any part of these Terms does not constitute a waiver of any right or provision. If any clause is found invalid or unenforceable by a competent court, the remaining provisions will remain in full force and effect.
